Terms and Conditions

These Terms and Conditions (“Terms”) govern participation in the Luxscape Referral Program (“Program”). By participating in the Program, the Referrer agrees to comply with all provisions herein.

  1. Definitions
    1. “Referrer” means any individual who introduces a prospective customer (“New Customer”) to Luxscape.
    2. “New Customer” refers to a person who enters into a binding agreement with Luxscape and remits the initial deposit for services.
  2. Eligibility and Referral Qualification
    1. The New Customer must not be previously known to Luxscape or have made prior contact with Luxscape.
    2. The New Customer must not have responded to Luxscape’s marketing, promotional, or advertising activities.
    3. Any New Customer already present in Luxscape’s database at the time of referral is ineligible for the Program.
    4. Referrals must be submitted using the designated online form or via a confirmation email from a Luxscape representative acknowledging receipt of the referral.
  3. Referral Fee and Payment
    1. Luxscape retains sole discretion to accept or reject any New Customer.
    2. Upon acceptance and compliance with these Terms, Luxscape shall pay the Referrer a referral fee of 2.5% of the contract price (“Referral Fee”).
    3. The Referral Fee shall be remitted within fourteen (14) calendar days following Luxscape’s receipt of the initial deposit from the New Customer.
    4. Payment shall be made by check or direct deposit to the Referrer’s nominated bank account.
  4. Multiple Referrals
    1. There is no limit to the number of New Customers a Referrer may introduce, provided each referral meets the requirements set forth herein.
  5. Program Modifications and Termination
    1. Luxscape reserves the right to modify, amend, or terminate the Program, including its structure, payment terms, and conditions, at any time and without prior notice.
  6. Limitation of Liability
    1. To the extent permitted by applicable law, Luxscape shall not be liable for any loss or damage suffered by a Referrer, New Customer, or any third party resulting from the inability of Luxscape to provide any aspect of the Program due to actions of any third party.
  7. Tax Matters
    1. Referrers are solely responsible for any tax obligations arising from receipt of referral fees. Distribution of referral fees is contingent upon completion of IRS Form 1099. Referrers are advised to consult with qualified tax professionals regarding potential tax liabilities.
  8. Governing Law and Jurisdiction
    1. The Program shall be governed by the laws of the State of Texas. Any disputes arising under or in connection with the Program shall be subject to the exclusive jurisdiction of the courts located in Harris County, Texas, USA.
